A recent episode of 99% Invisible explored some of the more colorful attorney advertisements across the country. The podcast invites listeners to consider how they perceive attorneys, in general, as a result of the advertisements of a few. The discussion with regulation counsel for the State of Florida also provides a good reminder for all attorneys to review the statements and representations made in the websites which now serve as the primary source of information about any practicing lawyer.

In recent years there have been a number of Colorado lawsuits against attorneys which looked, at least in part, to supposed promises and representations which were made in television advertisements, and on web pages. From a professional liability perspective, attorneys should schedule regular reviews of the content of all of their advertisements to ensure that they are fine with being questioned about any statement, and any post, made on their behalf.
