Colorado House Representative JoAnn Windholz has offered HB16-1133 for consideration by the Colorado House. While the bill contains changes to existing laws which may not be controversial, the proposed revisions to 12-61-1010, C.R.S. (2016) could create numerous opportunities for litigation by disgruntled Boards, Directors, and Owners. The bill, as currently drafted, would impose significant new duties and obligations on Community Association Managers which are vague, which may require consultation with counsel, and which could create numerous causes of action for any Owner in a common interest community when paired with 38-33.3-123(1), C.R.S. (2016).
The Bill, which currently has no co-sponsors, nor sponsors in the Senate, has been assigned to the House State, Veterans, & Military Affairs for review. We will continue to watch it as it moves through the legislature.
